THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.PRIVACY POLICIES CONTAINED IN A PRIVACY NOTICE ARE INCORPORATED BY REFERENCE HEREIN.BY ACCEPTING THESE TERMS & CONDITIONS, YOU ALSO ACCEPT OUR PRIVACY POLICIES CONTAINED IN THE NOTICE, WHICH MAY BE UPDATED FROM TIME TO TIME AS DESCRIBED THEREIN.

Purchase and Renewal Conditions:  By joining a discount dental services plan offered byAlligator Dental (each, a “Plan”), for yourself or on behalf of a minor child for whom you are a parent or legal guardian, you confirm that you are at least 18 years old and you authorize SystemTwo US Inc. d/b/a Alligator Dental to charge your credit card or checking account for the Plan you have selected.This charge shall automatically renew at the end of your membership term, and your credit card or checking account will be automatically charged for the appropriate amount, until you notify Alligator Dental through the contact information and procedures detailed below that you wish to cancel the Plan. By joining you indicate you have read and agree to the terms and conditions of the Plan.

Termination Conditions:  Alligator Dental reserves the right to terminate Plan members from its Plan for any reason, including non-payment or breach of these Terms. 

Cancellation Conditions:  You have the right to cancel within the first 30 days after the date of enrollment and receive a full refund, less a processing fee as specified in the enrollment form, if applicable. If for any reason during this time period you are dissatisfied with the Plan and wish to cancel and obtain a refund, you must submit a written cancellation request. Alligator Dental will accept cancellation requests at any time and will stop collecting membership fees in a reasonable amount of time, but no later than 30 days after receiving a cancellation notice. Please send a cancellation notification in accordance with the process detailed below and a request for refund with   your   name   and   member   ID.   You   may   also   submit   cancellation   requests by email to: help@alligator.dental. When you cancel, you will continue to have access to the Plan for the remainder of the month for which you have paid (and no refund is available for monthly plans or for the month in which you cancel); your membership will terminate at the end of that period.The preceding sentence does not apply to quarterly, semi-annual, or annual memberships inFlorida, North Dakota, and Oklahoma, where you will receive a pro-rata refund whenever you cancel, and your access to the Plan and its benefits may also be terminated immediately. For quarterly, semi-annual, or annual memberships, you will receive a pro-rata refund of your membership fees (not including the remainder of the month in which cancellation is requested).

Description   of   Services: Alligator   Dental   provides   members   access   to   a   network   of participating dentists from whom they may secure dental services at a discount.  The following is a list of attributes of the program delivered:

• Savings of 20% to 50% on most dental procedures including routine oral exams, unlimited cleanings, and major work such as dentures, root canals, and crowns
• Savings of 20% on orthodontics including braces and retainers for children and adults: A 20% reduction on specialists’ normal fees. Specialties include: Endodontics, Oral Surgery, Pediatric Dentistry, Periodontics, and Prosthodontics where available
• Cosmetic dentistry such as bonding and veneers is also included
• All dentists meet highly selective credentialing standards based on education, background, license standing and other requirements
• Members may visit any dentist who participates in the plan and/or change providers at any time

Limitations, Exclusions & Exceptions:  This Plan is a discount membership program offered by   Alligator   Dental,   utilizing   the   dental   provider   network of Careington International(careington.com). Neither Alligator Dental nor Careington International is a licensed insurer, health maintenance organization or other underwriter of health care services. No portion of any provider's   fees   will   be   reimbursed   or   otherwise   paid   by   Alligator   Dental or Careington International. Neither Alligator Dental nor Careington International is licensed to provide and does not provide health care services or items to individuals. You will receive discounts for services at certain health care providers who have contracted with the Plan or its affiliates or partners. You are obligated to pay for all health care services at the time of service. Savings are based upon the provider's normal fees. Actual savings will vary depending upon provider, location and specific services or products purchased. Please verify such services with each individual provider. The Plan's discounts may not be used in conjunction with any other discount plan or program. All listed or quoted prices are current prices by participating providers and subject to change without notice. Any procedures performed by a non-participating provider are not discounted. From time to time, certain providers may offer products or services to the general public at prices lower than the discounted prices available through this Plan. In such event, members may be charged the lowest price offered by the provider. Alligator Dental is not responsible in the event a provider does not offer its lowest available price via the Plan.Discounts on professional services are not available where prohibited by law. This Plan does not discount all procedures, and providers may participate for some procedures but not for others on a case-by-case basis. Providers are subject to change without notice and services may vary in some states. At any time Alligator Dental or Careington International may substitute a provider network at either party’s sole discretion. It is the member's responsibility to verify that the provider participates in the Plan. Alligator Dental cannot guarantee the continued participation of any provider. If your preferred provider were to leave the Plan, you will need to select another provider to continue to receive the discounts offered by the Plan.

Providers are solely responsible for the professional advice and treatment rendered to members.and   Alligator   Dental   disclaims   any   liability   with   respect   to   such   matters.   

ALLIGATOR DENTAL,   ITS   AFFILIATES,   AND   ITS   LICENSORS   SHALL   HAVE   NO   LIABILITY UNDER   ANY   CIRCUMSTANCES   RELATED   TO   ANY   PROFESSIONAL   ADVICE.ALLIGATOR DENTAL, ITS AFFILIATES, AND ITS LICENSORS SHALL NOT, UNDERANY   CIRCUMSTANCES,   BE   LIABLE   FOR   ANY   CONSEQUENTIAL,   INCIDENTAL,SPECIAL, OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

Some states do not allow the exclusion or limitation of certain categories of damages; therefore, the above limitation or exclusion may not apply to you.

Complaint Procedure: If you would like to file a complaint regarding your Plan membership, please utilize the contact procedures and information stated below. 

IF YOU REMAIN DISSATISFIED, YOU ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN ACLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS & CONDITIONS. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.

ANY DISPUTE SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE INTERNAL LAWS OF THE STATE OF NEW YORK. ALL CLAIMS SHALL BE   SETTLED   BY   CONFIDENTIAL,   EXPEDITED,   BINDING   COMMERCIAL ARBITRATION   IN   ACCORDANCE   WITH   THE   AMERICAN   ARBITRATION ASSOCIATION (AAA) IN EFFECT AT THE TIME OF THE DISPUTE.THE APPOINTING AUTHORITY SHALL BE THE AAA.THE PLACE OF ARBITRATION SHALL BE IN THE BOROUGH OF MANHATTAN, NEW YORK, PROVIDED THAT THE ARBITRATOR,WITNESS,   PARTY   REPRESENTATIVE,   COUNSEL,   EXPERT,   OR   STAFF   MAY PARTICIPATE   BY   VIDEO   CONFERENCE   WHERE   SUCH   PARTICIPANT   (WHEN PARTICIPATING) CAN BE HEARD AND SEEN (e.g., ZOOM).THE LANGUAGE OF THE ARBITRATION SHALL BE ENGLISH. 

YOU AGREE TO ARBITRATE ON AN INDIVIDUAL BASIS. IN ANY DISPUTE ARISING FROM   A   CLAIM,   NEITHER   YOU   NOR   ALLIGATOR   DENTAL   MAY   JOIN   OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER INDIVIDUALS OR ENTITIES IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS ACLASS   REPRESENTATIVE,   CLASS   MEMBER,   OR   IN   A   PRIVATE   ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding, without the written consent of all prospective parties thereto. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.

Entire Agreement; Severability: These Terms & Conditions and the Privacy Notice will be deemed the final and integrated agreement between you and Alligator Dental on the matters contained in these Terms & Conditions.If any term or provision of these Terms & Conditions is found to be invalid, illegal, or otherwise unenforceable, such finding shall not affect the other terms or provisions of these Terms &Conditions.
